Terms of Service

These Terms govern your access to and use of Budi, the report-drafting software operated by Budi Health. By creating an account or using Budi, you agree to these Terms and to our Privacy Policy.

1. The service

Budi takes information you provide and helps you generate structured draft reports. Budi is a drafting and productivity tool. It does not provide clinical advice, exercise clinical judgement, or make clinical decisions/recommendations. Every draft must be reviewed, corrected, and approved by a qualified professional before any clinical or formal use. You remain fully responsible for the accuracy, appropriateness, and final content of any report you produce.

2. Eligibility and accounts

You must be a professional (or acting on behalf of a practice) using Budi for legitimate work purposes. You are responsible for the security of your account credentials and for activity under your account. Notify us promptly of any unauthorised use.

3. Your data and ownership

You retain all rights to the notes, content, and information you input and to the reports you generate (“Your Data”). You grant us only the limited rights needed to operate the service for you — to store, process, and display Your Data so we can provide Budi to you. We will not use, disclose, or access Your Data except as necessary to provide the service, as you direct, or as required by law, and we will never use patient personal information to train, fine-tune, or improve AI models. Our handling of Your Data is described in the Privacy Policy.

4. Your responsibilities with client information

Much of Your Data concerns your clients. You are responsible for:

  • having the appropriate consent and lawful basis to input client information into a software tool and to use it to prepare reports;
  • complying with your own obligations under the Privacy Act, the Australian Privacy Principles, the NDIS Code of Conduct (where applicable), and your professional standards;
  • reviewing and verifying every draft before use.

5. Acceptable use

You agree not to misuse the service, including not attempting to reverse engineer, decompile, or access the underlying source code or models except as permitted by law; not using the service unlawfully; and not uploading content you have no right to provide.

6. Availability and changes

We aim to provide a reliable service but may modify, suspend, or update features over time. We will give reasonable notice of material changes where practical.

7. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where we are permitted to limit our liability, we do so as set out below. The disclaimers and limitations in these Terms apply subject to, and do not override, your non-excludable rights under the Australian Consumer Law.

8. Disclaimers

To the extent permitted by law and subject to clause 7, the service is provided “as is” and “as available”. Because Budi produces drafts that require professional review, we do not warrant that generated content is accurate, complete, or fit for any particular clinical or formal purpose without your review and approval.

9. Limitation of liability

To the extent permitted by law and subject to clause 7, we are not liable for indirect, incidental, special, or consequential loss, or loss of profits, data, or goodwill.

10. Indemnity

You agree to indemnify us against claims, losses, and costs arising from your breach of these Terms or your misuse of the service, including any use of client information without the consent or authority required under clause 4. This indemnity is limited to your own acts and omissions and is subject to clause 7; it does not extend to matters caused by us.

11. Suspension and termination

You may stop using Budi at any time. We may suspend or terminate access for breach of these Terms or where required by law. On termination, you may request export or deletion of Your Data, handled as described under Data retention and deletion in our Privacy Policy, subject to any legal retention obligations.

12. Governing law

These Terms are governed by the laws of the State of Queensland, Australia, and the courts of that jurisdiction.
